Acceptance of Terms

By accessing or using the services provided by PT Gafio Bahtera Nusantara ("Gafio," "we," "us," or "our"), including our website, platforms, and related services, you agree to be bound by these Terms of Service.

If you do not agree to these terms, you should not access or use our services. We reserve the right to modify these terms at any time, with continued use constituting acceptance of any changes.

Services

Gafio provides technology services including software development, IoT solutions, IT infrastructure, data analytics, system integration, and research & development. Our services may be delivered through direct engagement, our platforms (including Stageholder), or as described in specific service agreements.

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with reasonable notice where practical. Service-specific terms may apply in addition to these general terms.

User Obligations

You agree to provide accurate and complete information when using our services or submitting inquiries. You are responsible for maintaining the confidentiality of any account credentials and for all activities under your account.

You shall not use our services for any unlawful purpose, attempt to gain unauthorized access to our systems, or interfere with the proper operation of our platforms and infrastructure.

Intellectual Property

All content, designs, logos, trademarks, and materials on our website and platforms are the property of Gafio Bahtera Nusantara or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

Any intellectual property developed as part of a client engagement shall be governed by the terms of the specific service agreement between the parties.

Confidentiality

Both parties agree to maintain the confidentiality of proprietary information exchanged during the course of business. Confidential information includes, but is not limited to, business plans, technical data, financial information, and client data.

This obligation of confidentiality shall survive the termination of any business relationship and does not apply to information that becomes publicly available through no fault of the receiving party.

Limitation of Liability

To the maximum extent permitted by law, Gafio Bahtera Nusantara shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.

Our total liability for any claims arising under these terms shall not exceed the amount paid by you to us in the twelve months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Gafio Bahtera Nusantara, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of our services or violation of these terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising from these terms shall be resolved through the courts of Jakarta, Indonesia, unless otherwise agreed in a specific service agreement.

Termination

We may terminate or suspend your access to our services at any time, with or without cause, upon reasonable notice. Upon termination, your right to use our services will cease immediately.

Provisions of these terms that by their nature should survive termination shall remain in effect, including but not limited to intellectual property rights, confidentiality, limitation of liability, and governing law.
